To avoid potential legal problems, I think webmasters should ensure they comply with legal requirements of their state especially if they are selling things. A terms and conditions which you should bind customers to before they can order from your site is a very good way to draw customer's attention to the legal aspects of the transaction.
True. But most of the time, webmasters do not bother with updating their terms and conditions. Chances are that if they used a pre-made script, their terms and conditions are indentical to what was originally included in the script.
Some webmasters who are lazy also copy terms and conditions from other websites.
You are quite right about this, I have fallen into the same trap but since a legal issue arise out of a project in the past I am now a bit more careful
